7 years ago: 2 guys convicted of murdering man who is known to have died of cholera.
Video will show frustrating effort to have them released.
Judges cannot be found.
Judges on 2 month holiday.
Files lost.
Finally judge orders their release…
FILE LOST AGAIN AND THEY ARE STILL IN PRISON.
Present situation was passed to Commissioner of Government/Justice Minister by President Moise – resulting in no progress. Just the usual Haitian governmental obfuscation, avoidance, name calling, denial….AND NO ACTION!!
People are dying because of this criminal, horrific, unconstitutional situation that can be eliminated with the stroke of a pen!!
SIMPLY RECOGNIZE AND ACT UPON ARTICLE 26 OF OUR CONSTITUTION AND RELEASE THOSE WHOSE RIGHTS HAVE BEEN IGNORED, IGNORED, IGNORED AND IGNORED!!
OR IS THE CONSTITUTION FOR THE FEW WITH CASH AND NOT FOR THE 12,000,000 WITH NOTHING?

No one may be kept under arrest more than forty-eight (48) hours unless he has appeared before a judge asked to rule on the legality of the arrest and the judge has confirmed the arrest by a well-founded decision;

This entire delay has seen another missed opportunity.
There was the offer that immediate action, almost 2 years ago, would bring a nomination for the Nobel Prize.
The nomination was a guarantee.
A win was Borlette.
But a nomination would have been a great public relations coup for the Jovenel Moise government. Unfortunately, President Moise is surrounded by a bunch of people who have their own agendas, and these rarely coincide with those of the President.
Many are counterproductive.
The delay has seen events overtake us.
An international study has shown that Haiti has the worst prison conditions of any country in the world.
Now any positive action, on the part of the Jovenel Moise Government will be seen as a reaction to international pressures.
No matter how it may be seen, the Jovenel Moise government will gain a great deal of positive support, throughout Haiti, if those held, in violation of ARTICLE 26 are released immediately!

President Moise should use your suggestion and have courts rule the prisoners’ right have been violate under Article 26 and release them immediately.
Once you view this honest, balanced video you will see basic problems faced by the Haitian legals system.
It is not a crticism of the Jovenel Moise government. They did not create the problem. However, President Moise is to blame, and will be judged as the one to blame if he does not move to solve this easily solved problem.
The quake and other problems have broken the system even as new prisoners flow into the impossibly crowded facilities.
If the system was functioning perfectly, 8 hours per day, the courts could not deal with the overflow.
By simply accepting the Constitutional requirement of Article 26 President Moise will be the hero.
