
PREAMBLE
We, representatives of the political, social, institutional and citizen forces of the Republic,
Noting the vacancy of the Presidency with the departure of the Transitional Presidential Council (CPT) on 7 February 2026;
Having regard to the Resolution taken and enacted by the qualified majority of 5 members of the Transitional Presidential Council dated Wednesday, January 21, 2026 dismissing Prime Minister Alix Didier FILS-AIMÉ;
Aware that the dismissed Government of Alix Didier FILS-AIMÉ is currently liquidating current affairs;
Aware that Articles 148 and 149 of the Constitution of 29 March 1987, as amended, relating to presidential vacancies, presuppose the existence of functional constitutional institutions and the capacity of the State to organize elections within the time limits set by these articles, i.e. a period not exceeding 120 days;
Aware of the seriousness of the multidimensional crisis that the Nation is going through, characterized in particular by the collapse of national security, the paralysis of institutions, the deterioration of the national economy and the erosion of citizen confidence, making it materially impossible to apply these constitutional provisions;
Acknowledging the impossibility, under the current circumstances, of organizing free, inclusive, credible and secure elections within the strict ordinary constitutional calendar;
Considering the imperative need to ensure the continuity of the State, the safeguarding of national sovereignty and the preservation of the fundamental constitutional order;
Considering that the convening of the Haitian people to their electoral comitia is an imprescriptible and exclusive constitutional prerogative of the President of the Republic;
Considering that the overriding principle of State continuity requires the adoption of exceptional, temporary and proportionate measures in order to preserve national sovereignty and fundamental rights;
Considering that an inclusive national political consensus constitutes, in the current circumstances, the only source of effective legitimacy to lead an orderly transition to free, inclusive and credible elections;
Reaffirming our commitment to democratic principles, the separation of powers, the rule of law, human rights and the international commitments of the Republic;
Convinced that a consensual temporary political transition is the responsible way to create the conditions for the restoration of security, governance and the organization of credible elections;
Have agreed as follows:
Article 1: PURPOSE OF THE ACT OF NATIONAL CONSENSUS
This Act enshrines the national political consensus around the appointment of a provisional President of the Republic responsible for leading the political transition until the installation of the constitutionally elected President, in an exceptional and temporary framework.
The provisional President of the Republic is responsible for setting up a government, rather technocratic, composed of competent, honest and credible personalities.
ARTICLE 2: BASIS FOR CONSENSUS
The consensus expressed in this Act shall be based on:
- Recognition of the effective and prolonged vacancy of normal constitutional governance;
- The agreement of the signatory political forces on the need for a two-headed transitional executive demanded by the national collective conscience;
- The common will to avoid any chaos, any seizure of power by force, any authoritarian drift or any institutional fragmentation;
- The collective commitment to restore democratic legitimacy through elections ending the transition.
ARTICLE 3: APPOINTMENT OF THE PROVISIONAL PRESIDENT
The signatory parties thus recognize and endorse the appointment of Citizen: Wilner VALCIN, as Provisional President of the Republic of Haiti, for the period from his official investiture until the installation of a constitutionally elected President.
The Provisional President of the Republic shall exercise full presidential powers in accordance with fundamental constitutional principles and with a view to restoring constitutional order.
Article 4: MANDATE
The mission of the President of the Republic, although defined in the Constitution and the laws, is, without being exhaustive, oriented towards:
- The restoration of the authority of the State over the entire national territory;
- The restoration of national security and republican order;
- The proper effective and regular functioning of the public authorities;
- Socio-economic appeasement;
- The revival of the national economy and essential services;
- The Guarantee of Fundamental Freedoms and Human Rights;
- Conducting the necessary institutional reforms;
- The continuation of the inter-Haitian dialogue for the elaboration of a Governability Pact;
- The preparation and organization, in conjunction with the competent institutions, of credible, free, inclusive, honest and transparent general elections for the renewal of Haitian political personnel with a view to returning to democratic order.
Rule 5: END OF THE TERM OF OFFICE OF THE PROVISIONAL PRESIDENT
This transition ends by operation of law:
- to the realization of free and credible elections
- the installation of the constitutionally elected President of the Republic,
Article 6: NEUTRALITY
The Provisional President:
- abstain from any partisan activity;
- acts in a spirit of neutrality, impartiality and national cohesion.
Article 7: ORGANIZATION OF THE EXECUTIVE POWER
Executive power in the dynamics of the transition is exercised in accordance with the spirit and the letter of the applicable provisions of the Constitution of 29 March 1987, as amended.
Article 8: SWEARING-IN OF THE PROVISIONAL PRESIDENT OF THE REPUBLIC
Before taking office, the Provisional President shall take the following oath before the Nation:
” I swear, before God and before the Nation, to respect and ensure respect for the constitutional principles and laws of the Republic, to exercise the power entrusted to me solely in the best interest of the Haitian people, to preserve national sovereignty, to guarantee security and fundamental rights, and to hand over power to the constitutionally elected authorities.”
ARTICLE 9: COMMITMENTS OF THE SIGNATORY PARTIES
The signatory political and social forces commit to:
- Recognize the authority of the Provisional President during the transitional period;
- Refrain from any action aimed at destabilizing the transitional order;
- Participate in good faith in the work of national consultation;
- Respect the timetable and rules of the electoral process.
Article 10: TRANSPARENCY AND ACCOUNTABILITY
The Provisional President regularly reports on his action to the Nation in the greatest transparency.
Article 11: FINANCIAL AND ADMINISTRATIVE CONTROL
The Superior Court of Auditors and Administrative Disputes (CSCCA) fully exercises its oversight functions.
Article 12: CONTROL AND ACCOUNTABILITY
The control of government action is ensured by:
- the competent courts,
- the CSCCA,
- the supervisory bodies,
- periodic public surrender.
The Transitional Executive is required to:
- periodic public reports;
- independent audits;
- transparency mechanisms accessible to the public.
ARTICLE 13: COMMUNICATION
This Act reads as follows:
- Brought to the attention of the Haitian people;
- Notified to national institutions;
- Communiqué to the diplomatic representations, regional and international organizations partners of the Republic of Haiti.
It provides a legitimate political basis for the national and international recognition of the transitional authorities.
ARTICLE 14: COMING INTO FORCE
This Act, inscribed in the expression of the national will for a two-headed executive, is published for all purposes of law for the safeguarding of social peace, the guarantee of the hopes of the Haitian people and remains in force until the effective end of the transition

Déclarons avoir pris connaissance intégrale de l’Acte de Consensus National, en avoir librement débattu, en accepter les principes fondamentaux, les objectifs, les engagements réciproques ainsi que les mécanismes de mise en œuvre et de suivi,
Et, en conséquence,
Nous engageons solennellement nos institutions, organisations et personnes morales ou physiques respectives à respecter, promouvoir et appliquer le présent Acte, dans le cadre de la Transition, du rétablissement de l’État, de la paix civile, de la sécurité nationale et du retour à l’ordre constitutionnel démocratique.
