I welcome the arrival of my colleague Advisor-President, Fritz Alphonse Jean, as President – or Coordinator – of the Presidential Transition Council (CPT). Faced with the questions that animate the public space and give rise to lively debates, it is my duty to provide institutional insight in order to dispel any confusion.
It should be recalled that the President of the CPT is not the President of the Republic but of the Council http://Présidentiel. The function of President is managed collegially in accordance with the provisions of Article 4 of the Decree establishing the CPT, which provides that: “The Transitional Presidential Council exercises specific presidential powers of the Presidency during the Transition period.”
The President of the CPT exercises coordination and representation functions but has no authority over his peers and acts in accordance with the fundamental principle of collegiality that governs the Council.
As such, he is authorized to affix his signature on behalf of the CPT only with the agreement of the other members. Any document signed without the approval of the other members of the Council will be absolutely null and void.
The Council of Ministers must be attended by at least five (5) voting members, and no decision may be ratified without having received the approval of at least five (5) voting members.
Respect for these principles is not an option, but a democratic and institutional requirement.
It is by remaining faithful to the spirit and letter of the founding decree of the CPT and the one determining the organization and mode of operation of said Council that we will guarantee the stability of the Transition and the legitimacy of the decisions taken within it.
