Me Néhémie Joseph is no longer a member of the CSPJ

Thursday during an Assembly of the Bars Federation of Haiti (FBH) it was decided that Me Néhémie Joseph leaves his position as representative of the FBH, within the Superior Council of the Judiciary, because the end of mandate of the Bar of Gonaives and in accordance with Article 11 of the Law on the establishment of the CSPJ which states “If a member of the Council, loses its quality while in office, there will be a replacement in the form and conditions prescribed by this Act. The one who replaces, continue the mandate for the unexpired time.”

For the FBH, Me Néhémie Joseph, is no longer a practicing barrister, the law should apply and he must be replaced.

For Me Néhémie Joseph, the decision to remove him from the CSPJ, comes from an interpretation of the law by the Assembly, that he accuses of being subject to the orders of the Executive, which would be, according to him, the cause of his departure… For Me Néhémie, his mandate is 3 years, according to his reading of the law.

Me Carlos Hercule, , President of the FBH, has vigorously denied the allegations of Me Néhémie, like what the Federation is subject to the will of the Executive recalling that the population is able to judge whether the Federation of bars used to comply or not to the will of the Executive.

Sweeping arguments of Me Néhémie, the Federation announced that it will soon be in elections to replace its representative and not let the CSPJ amputated of one of its members.
