Following the disputed minority vote, of 24 July, designating the 3 representative of Judicial Power [Patrick Métellus, Yves Benoit Jean-Marie and Salnave Exantus] for the Permanent Electoral Council (CEP), Me Anel Alexis Joseph, President of the Superior Council of the Judiciary (CSPJ) challenged from all sides and put under pressure, has finally gave way and convened yesterday Friday, at the School of Magistrates, the members of the CSPJ.
After deliberation, the members have voted (5 on 7) for the resumption of the process of designation of three representatives of the Judiciary to the CEP, from the list of 12 candidates. Marie Edith Dilia Lemaire, Representative of Haitian Organisations for the promotion and defense of human rights and Me Néhémie Joseph, Representative of the Bar of Port-au-Prince to the CSPJ, who resigned were not present at the meeting.
The CSPJ should meet next Tuesday in order to choose in a new poll, its 3 representatives to the CEP. Me Anel Alexis Joseph promised to immediately inform the Head of State of the decision of the majority, wanting the resumption of the designation process.
Implicitly this vote, calls into question the appointment of 3 members of the Judiciary installed to the CEP. However, Me Anel Alexis Joseph does not recognize openly this questioning of 3 members already installed to the CEP, seeming to rely on the unwavering support of Jean Alix Civil (Government Commissioner of the Court of First Instance of Petit-Goâve, hosen by the Minister of Justice), it seems to seek a formula, that would allow to avoid that the decision next Tuesday, is inconsistent with the vote on 24 July.
